Terms of Service and Sale

These Terms of Service and Sale (the "Terms") govern your access to and use of the ENVELIA website (the "Website") and any purchase of products made through the Website (the "Products"). By accessing the Website, creating an account, placing an order, or otherwise using the Website, you agree to be legally bound by these Terms.

If you do not agree, do not use the Website and do not place an order.

These Terms are between you and Envelia ("ENVELIA," "we," "us," "our"). You may contact us at contact@envelia.com.

  • "Account" means a user account created on the Website.
  • "Consumer" means an individual acting for purposes wholly or mainly outside their trade, business, craft, or profession.
  • "Business Customer" means any person or entity acting for purposes relating to their trade, business, craft, or profession.
  • "Order" means a purchase request submitted through the Website.
  • "Order Confirmation" means the email acknowledging receipt of your Order.
  • "Shipping Confirmation" means the email confirming dispatch of your Order.
  • "Personal Data" means information relating to an identified or identifiable person.
  • "User Content" means any content you submit (reviews, photos, comments, etc.).
  • "Force Majeure Event" means an event beyond reasonable control (as defined below).

By accessing and using the ENVELIA website, you agree to be bound by these Terms of Sales. If you do not agree with any part of these terms, you may not use our services.

We process Personal Data to operate the Website, provide customer support, fulfill orders, prevent fraud, comply with legal obligations, and improve our products and services. Typical categories of Personal Data include identification and contact details (name, email, phone, shipping address), order and transaction details, customer communications, device and usage data (such as IP address, browser type, and pages viewed), and in some cases marketing preferences.

We may share Personal Data with service providers strictly as needed to perform services on our behalf, such as payment processors, shipping carriers, logistics providers, website hosting, analytics, and customer support tools. We may also disclose Personal Data where required by law, to respond to lawful requests, or to protect rights, safety, and security (including fraud prevention).

Where required by applicable law, you may have rights such as access, rectification, deletion, objection, restriction, portability, and withdrawal of consent (where processing is based on consent). To exercise privacy rights, contact contact@envelia.com. We may need to verify your identity before responding.

Cookies and similar technologies may be used for essential functionality, performance, analytics, and advertising (where enabled). Where required by law, you will be offered cookie controls.

You may be able to place an order as a guest, but certain features may require an Account. If you create an Account, you must provide accurate and complete information and keep it updated. You are responsible for safeguarding your credentials and for all activity under your Account. Notify us immediately at contact@envelia.com if you suspect unauthorized use.

We may suspend or terminate Accounts where we reasonably believe there is fraud, abuse, unlawful activity, security risk, or a material breach of these Terms.

You may use the Website only for lawful purposes and in compliance with these Terms. You must not misuse the Website, including by:

  • (a) attempting unauthorized access to systems or accounts;
  • (b) interfering with Website security or performance;
  • (c) introducing malware or harmful code;
  • (d) scraping, crawling, data-mining, or using automated means to extract data without our prior written consent;
  • (e) using the Website to misrepresent identity, commit fraud, or post fake reviews;
  • (f) infringing intellectual property or other rights.

We may modify, suspend, or discontinue the Website (in whole or in part) at any time for maintenance, security, improvement, or operational reasons.

By placing an Order, you make an offer to purchase Products subject to these Terms. An Order is not accepted until we send a Shipping Confirmation (or otherwise confirm dispatch). We may refuse or cancel an Order (in whole or in part) for reasons including but not limited to stock unavailability, pricing or description errors, suspected fraud, abusive behavior, violations of these Terms, shipping restrictions, or legal/regulatory constraints.

Pricing and errors. Prices and availability may change at any time. If an obvious pricing or listing error occurs, we may correct it and cancel affected Orders. If we have already charged you and cancel an Order, we will refund the amount charged for the cancelled portion.

Payment. You authorize us and/or our payment processors to charge your selected payment method for the full amount shown at checkout (Products, shipping, and any taxes we are required to collect). If payment is declined, reversed, or charged back, we may suspend fulfillment, cancel the Order, and/or restrict Accounts where lawful.

Taxes. Depending on where you live and where Products ship from, sales tax/VAT/GST may apply. Taxes that we are required to collect will be shown at checkout where applicable.

We may limit quantities per Order, per customer, per household, per Account, or per period, including to prevent fraud, stockpiling, and unauthorized resale. We may refuse or cancel Orders we reasonably believe are placed for resale or commercial distribution.

General return window (global). Unless a mandatory local law provides a longer period, we offer a 30-day return window from the date of delivery for eligible Products.

Eligibility conditions. To qualify for a return, Products must be returned in unused condition, with original packaging where reasonably possible, and must not be damaged due to misuse, mishandling, or improper storage after delivery.

How to request a return. Email contact@envelia.com within the applicable return window with (i) your order number, (ii) the item(s) you want to return, and (iii) the reason. We will provide return instructions.

Return shipping costs. Unless mandatory consumer law provides otherwise, return shipping costs are paid by the customer, except where the return is due to our error (wrong item) or a verified defect/damage on arrival.

Refunds. If your return is approved, refunds are issued to the original payment method. Processing times vary by payment provider and bank. Original shipping charges are non-refundable unless required by law or unless the return is due to our error or verified damage/defect.

Damaged, defective, or incorrect items. If your item arrives damaged, defective, or incorrect, you must contact us within 7 days of delivery and provide reasonable evidence (photos of the item and packaging).

EU/UK Consumer withdrawal rights (mandatory). If you are a Consumer in the EU or UK, you generally have a legal right to withdraw from a distance purchase within 14 days of delivery without giving any reason, subject to statutory exceptions.

Estimated timelines. Shipping timelines shown at checkout are estimates and not guarantees. Delays can occur due to carrier operations, customs processing, peak seasons, weather, or other factors outside our control.

Address accuracy. You are responsible for providing a complete and accurate delivery address. If an Order is returned due to an incorrect address, failure to accept delivery, failure to pay required import charges, or failure to collect the parcel, we may (at our option, where lawful) reship at your expense or issue a refund minus any actual shipping/return costs incurred.

International shipping; customs, duties, and import taxes (important). For international deliveries, you may be responsible for import duties, customs fees, brokerage fees, and local taxes imposed by the destination country. Unless we explicitly state at checkout that duties/taxes are included, shipments are provided on a DAP/DDU basis (Delivered At Place / Duties Unpaid): you pay any import charges required to receive the parcel.

Risk of loss. Risk of loss passes according to mandatory law. Where permitted by law, risk transfers when the carrier marks the package delivered to the address provided.

Lost or "delivered but not received." If tracking indicates a parcel is lost in transit, or marked delivered but you did not receive it, contact contact@envelia.com promptly. We may require a carrier investigation and reasonable supporting information.

Products are sold for personal use only. You may not resell, distribute, or commercially exploit Products, packaging, or ENVELIA content without our prior written permission. We may refuse or cancel Orders and restrict future purchases where we reasonably suspect resale or commercial distribution.

Use and safety. Shoe-care products should be used as instructed and with care. Always test on a small inconspicuous area first, avoid contact with eyes and ingestion, and keep Products away from children. Results may vary depending on materials and condition. To the maximum extent permitted by law, ENVELIA is not responsible for damage caused by misuse, failure to follow instructions, or application to incompatible materials.

First step: contact us. Before filing a formal claim, you agree to contact us at contact@envelia.com and attempt in good faith to resolve the dispute informally, unless urgent relief is required or mandatory law prohibits such a requirement.

Governing law. These Terms are governed by the laws of the Kingdom of Morocco, without regard to conflict-of-law principles, except that mandatory consumer protection laws in your country of residence may still apply and cannot be waived.

Jurisdiction. Unless mandatory law provides otherwise, the courts of Casablanca, Morocco have exclusive jurisdiction over disputes arising out of or relating to these Terms, the Website, or Orders. If you are a Consumer, you may also have the right to bring claims in the courts of your place of residence where required by mandatory law.

Additional Terms (International-grade protections)

All Website content, including trademarks, logos, product names, text, graphics, photos, videos, designs, and software, is owned by or licensed to ENVELIA and is protected by intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works, or exploit any content without our prior written permission.

If you submit User Content, you represent that you have the rights to do so and that it is accurate and lawful. You grant ENVELIA a worldwide, royalty-free, non-exclusive, sublicensable license to use, reproduce, display, distribute, and adapt your User Content for Website operation, marketing, and product improvement purposes, subject to applicable privacy laws. We may remove or moderate User Content at our discretion.

Promotions and discount codes are subject to conditions disclosed at issuance and may be modified or ended at any time where lawful. Unless stated otherwise, discount codes are non-transferable, not redeemable for cash, and may not be combined. We may refuse redemptions where we reasonably suspect abuse, fraud, or error.

The Website may rely on third-party services (payment processing, shipping carriers, analytics, hosting) and may contain third-party links. We do not control third-party services and are not responsible for their terms, policies, or performance. This does not limit any non-waivable Consumer rights.

To the maximum extent permitted by law, the Website and Products are provided "as is" and "as available," without warranties of any kind except those that cannot be disclaimed under applicable law. We do not guarantee uninterrupted or error-free Website operation.

To the maximum extent permitted by law, ENVELIA will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising out of or related to the Website, Products, or these Terms.

To the maximum extent permitted by law, ENVELIA's total liability for any claim will not exceed the amount you paid for the specific Order giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law (including certain liabilities relating to fraud, willful misconduct, or mandatory consumer protections).

To the maximum extent permitted by law, you agree to indemnify and hold harmless ENVELIA from claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your misuse of the Website, breach of these Terms, or violation of law or third-party rights.

ENVELIA is not responsible for delays or failures caused by a Force Majeure Event, including natural disasters, war, terrorism, labor disputes, supply chain disruptions, carrier interruptions, governmental actions, pandemics, internet outages, or payment network failures. Obligations affected are suspended for the duration of the Force Majeure Event.

You represent that you are not subject to sanctions or restrictions that would prohibit purchasing or receiving Products. We may refuse, cancel, or restrict Orders where required to comply with sanctions, export controls, payment network rules, or other legal obligations.

We may update these Terms to reflect legal, technical, or business changes. Updates take effect on the "Effective date" above. Continued use of the Website or placing Orders after the effective date constitutes acceptance, except where mandatory law requires additional steps.

You consent to receive communications electronically (email and Website notices). Electronic communications satisfy legal "writing" requirements where permitted by law.

If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.

Failure to enforce any provision is not a waiver of our right to enforce it later.

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, corporate reorganization, or sale of assets.

These Terms constitute the entire agreement between you and ENVELIA regarding the Website and Orders, superseding prior or contemporaneous understandings on the subject.

These Terms are drafted in English. Translations may be provided for convenience only. To the extent permitted by law, the English version controls in case of conflict.
